Just a month before welcoming her new baby to the world, Jodie Garrod's partner Jamie died having suffered a brain haemorrhage.

 

At just 26 years old, the young dad was on life-support until his family made the agonising decision to turn it off.

 

A few short weeks later Jodie gave birth to the couples second daughter, Olivia.

 

However, Jodie is now being told that she cannot put her late partner's name on Olivia's birth certificate as he was not present when she was registered.

 

Legislation currently says an unmarried mother and father much meet the registrar before their names are included on the certificate.

 

Jodie now must face the heartbreaking task of getting DNA from one of her partner's relatives to see if it matches with her new little girl.

 

Jodie told The Mail:

 

"The certificate is blank next to the section 'father' because they wanted proof that she is actually his. What more do they need when they know that she has his surname?"

 

"We will have to get DNA from a relative of his to match it with Olivia's if we are going to have a hope of getting his name on the certificate."

 

Speaking about how the girls take after their father, Jodie said:

 

"She had to be called Olivia because that is what Jamie wanted. She looks like him. Both Olivia and our other daughter Amelia have his gorgeous blue eyes."

 

"Olivia is just like her dad, laid back and doesn't cry and you only hear her when she is hungry. I want his name to be on the birth certificate. We were not married but she has his name."

 

This issue falls to The Home Office who said:

 

"It is important that all details on a birth certificate are recorded accurately."

 

"In the sad circumstances where the parents are not married and the father has died before the birth has been registered, we rely on a court to make a declaration of parentage after considering the relevant evidence."
