While some divorce cases and custody arrangements can be amicable, this star’s story is a rather tragic example of how wrong things can go.

 

Days after actress Kelly Rutherford took matters into her own hands by refusing to send her two children back to her ex-husband in Monaco, she has taken yet another defiant stand.

 

The former Gossip Girl actress was urgently ordered to appear before a New York court with Hermes, 8, and Helena, 6, today, where she was scheduled to surrender her little ones.

 

While the 46-year-old was photographed attending the court hearing earlier today, it appears that she defied the order by turning up without her son and daughter.

 

Kelly released a statement last weekend, stating her intention to keep her children with her. Her decision came after courts in both New York and Los Angeles rejected her appeal for sole custody, insisting that neither of them had jurisdiction to hear the case.

 

 

Since Kelly’s dramatic move, ex-husband Daniel Giersch has come out to publicly accuse her of child abduction.

 

Giersch’s attorney, Fahi Takesh Hallin, said in a statement: “He [Daniel] is very concerned about the traumatic impact that Kelly’s behaviour will have on the children…Child abduction is a crime, and everyone involved in kidnapping or abducting the children will face the appropriate legal consequences.”
