We have been closely following the custody battle between Gossip Girl actress Kelly Rutherford and her ex husband Daniel Giersch, and there have been further updates in Kelly’s quest to get her two children back.

 

The mum-of-two, who has been fighting to get her kids, eight-year-old Hermés and Helena, who is almost six, back after they were ordered to move to Monaco to live with their father, has been granted temporary custody by a California judge, according to People magazine.

 

And while the family will have to wait and see if Monaco will agree to allow the children leave, Rutherford’s lawyer Wendy Murphy states: “It has long been our position that Monaco has no jurisdiction because Hermes and Helena, as American citizens, have an absolute right to live in their own country."

 

The news comes after it emerged that Daniel refused to allow her see her two children on her recent trip to France and ordered her to hand over their US passports.

 

 

According to the magazine, a court order filed states that the children are to be sent to Los Angeles where Kelly lives and that she will keep their passports.

 

Kelly has been fighting for her kids since 2012 when Daniel’s visa was revoked and a judge ordered the children to live with their father in France.
