An Australian family who have been fighting to remain in the Highlands of Scotland have now been told by the Home Office to leave the UK.

 

Gregg Brain and his wife Kathryn moved from Brisbane to Dingwall in Scotland in 2011 on a student visa as he was studying Scottish history and archaeology.

 

On completion of his course, the family planned to stay using the post-study work visa which meant that non-EU graduates could remain in the UK for at least two years.

 

 

However, this scheme was scrapped by the British Government in 2012 which lead to the family being a part of lengthy and high-profile case to remain in the country.

 

Seven-year-old Lachlan was attending school in the country since the family moved but they are now being sent home as they do not meet the Home Office visa requirements.

 

 

Kathryn has been set the deadline of midnight on Monday to secure a job that complies with these requirements.

 

So far, the mum says she has received dozens of job offers but none that qualify for a UK tier two visa.

 

The Scottish National Party MP Ian Blackford received a letter from the Home Office saying that the Brains will no longer have any grace period and must return to Australia however he is continuing to fight for the family.

 

"My duty over the coming days and weeks is to do all I can to assist the family, not coerce the family to leave," he wrote on Facebook.
