There have been some very high profile custody and parental battles playing out in the past few weeks, and the following has been making headlines all over the world today.

 

A court in the UK has ordered for a child who was carried by a surrogate for a male gay couple to be given back to the two men.

 

The Romanian woman had made an informal surrogacy agreement with the two men, but reportedly lied about her intentions. The High Court in London heard this week how the woman intended from the outset to keep the child, looking upon the child’s gay father as no more than a ‘sperm donor’.

 

The woman went on to name and baptise the child, a girl, without the couple’s consent. The woman, referred to only as S, claims she had agreed to being the child’s “main parent and carer”, which has been denied by the child’s father.

 

 

In the final hearing in the case today, Ms Justice Russell called for the now 15-month-old child to be returned to the couple. She also went on to criticise the surrogate for the ‘homophobic’ language she used when speaking about the couple in court.

 

“The girl should live with her father and his partner as it is in her best interests to do so,” said Ms Justice Russell.

 

It is believed that the case may pave the way for stricter, more formal rules on surrogacy going forward.
