An investigation has been launched this week into the legality of the arrest of an almost nine months pregnant woman in Waterford.

 

Romanian Ancutu Rostas, with an address in Waterford, was reportedly arrested and convicted of theft, before being handed down two six-month consecutive sentences. These sentences were then suspended by Waterford District Court.

 

Shortly after, Ms Rostas was convicted of a begging offence by the Tipperary District Court, and her previous sentences were activated by the judge as soon as they were made known during the hearing.

 

Yesterday, High Court judge Ms Justice Marie Baker heard how, when Ms Rostas’ sentence was activated, she was held in Mountjoy Women’s Prison just weeks ahead of her child’s birth.

 

Following yesterday's hearing, Ms Rostas has been released on bail due to the fact that she was arrested almost nine months into her pregnancy.

 

During yesterday’s hearing, Ms Justice Baker ordered for Ms Rostas to be released on bail pending an investigation into whether or not it was legal to have her incarcerated.

 

The case has now been adjourned until next Monday, August 24th, and we will keep you updated on the case as it unfolds.
