A woman, who gave birth in 2013, has successfully sued two consultants after a swab was wrongfully inserted during childbirth in a medical error which led to significant infection.

Sarah Daly from Rathfarnham in Co. Dublin has been awarded €117,000 in compensation after Mr. Justice Kevin Cross acknowledged a catalogue of errors in her treatment at Mount Carmel Hospital three years ago.

The court heard that Ms. Daly had suffered considerably after medical professionals wrongfully inserted a swab, and then failed to conduct an internal examination when the new mother returned to hospital in extreme pain and distress three days after delivering her child.
 


Further to this, it was established that once the swab was eventually detected and ultimately removed five days after childbirth, Ms. Daly was discharged from hospital without receiving an antibiotic in an error which ultimately led to a serious infection.

Ruling against consultants Valerie Donnelly and Charles Julian Dockeray who stood in for the former on April 22nd 2013, Mr Justice Kevin Cross insisted both the initial failure to remove the swab and the subsequent lack of detection justified the six-figure sum awarded to Ms. Daly.
