A woman, who declared she was not 'culturally prepared' to raise a mixed-race child in an 'all-white neighbourhood' after being impregnated by a black sperm donor, has had her court case thrown out.

Jennifer Cramblett, who chose a white donor while under the care of the Midwest Sperm Bank, was inadvertently provided with a black sperm donor as a result of a clerical error.

On account of this, Jennifer was offered a partial refund - something which the new mother and her partner felt fell short of their expectations and led them to seek legal guidance.

Filing a case for 'wrongful birth', Jennifer justified her decision by explaining that raising a mixed-race daughter in the conservative and 'racially intolerant' neighbourhood of Uniontown, Ohio, has caused undue stress.
 


While acknowledging the love they both share for their two-year-old daughter, Payton, Jennifer and her partner said they feared for their child as she would gradually become exposed to her mother's 'all white and unconsciously insensitive family' who struggled to accept Jennifer's homosexuality.

Considering Jennifer's case, Du Page County judge, Ronald Sutter, ruled in favour of the clinic and asserted that the charge only pertains to cases which lead to the birth of an unhealthy child.

As Payton was born healthy with no complications, the judge advised Jennifer to refile her case under a negligence claim.

It is understood that Jennifer and her partner will be due back in court at the end of this year.
