A secondary school in Wicklow is challenging a planning approval for a new McDonald’s that will be located less than 100 metres away.

 

Temple Carraig in Greystones, Co. Wicklow, who have taken action, has said that the site was chosen by the restaurant because of its close proximity to three schools, including Caelscoil na gCloch Liatha and Grestones Educate Together, which have a combined total of 1,800 students.

 

They have also claimed that An Bord Pleanála failed to take into consideration national policy which is trying to reduce childhood obesity.

 

The proposed development at the Blacklion Neighbourhood Centre will also include a drive though, a health and fitness studio and a commercial unit.

 

According to the Irish Times, Jarlath Fitzsimons SC for Temple Carraig, who has taken the action on behalf of all schools concerned, said his client is objected to the plan for a number of reasons including its disregard to relevant government policies.

 

Explaining their reasons, the board of management said: "[We] taken this step in light of its responsibilities under the Education Act to provide for the students of the school and on the basis of strong legal advice that the decision by An Bord Pleanála to grant permission for the proposed development was legally flawed". 

 

There is just 30 meters between the proposed restaurant and a lane beside the school and just 89 meters away from the school’s entrance.
